General Terms and Conditions

1. Scope and Contracting Parties

The contracting party and seller (hereinafter „we“ / „Seller“) is:

These terms apply to contracts you enter into with us as a consumer or as a business through our online shop. The version applicable is the one in force at the time of the order.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By submitting your order via the button marked as subject to payment, you make a binding offer. The contract is concluded once we accept the order by way of a separate order confirmation by email or by delivery of the goods. An automatic acknowledgement of receipt of the order does not yet constitute acceptance.

3. Prices and Shipping Costs

All prices are in euros and include statutory VAT. Shipping costs may apply in addition to the stated price; these will be shown separately before the order is completed. Details on shipping costs, delivery area and delivery times can be found on the page Shipping & Payment.

4. Payment

The payment methods offered during the ordering process will be shown to you before the order is completed; an overview can be found on the page Shipping & Payment. The purchase price is due for payment upon conclusion of the contract.

5. Delivery

We deliver within the area specified on the page Shipping & Payment . Alternatively, collection from the winery is possible by arrangement. Delivery times given are estimates and non-binding, unless a fixed delivery date has been expressly agreed.

6. Protection of Minors / Proof of Age

We only supply alcoholic beverages to persons who have reached the age of 16 (wine and beer; spirits from the age of 18), in accordance with the applicable regulations on the protection of minors. By placing an order, you confirm that you have reached the required minimum age. Age will be checked (proof of ID) upon handover of the goods; goods will not be handed over to minors.

7. Right of Withdrawal for Consumers

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire fourteen days from the day on which you or a third party other than the carrier and indicated by you, acquire physical possession of the goods. In the case of an order comprising multiple goods delivered separately as part of a single order, the period runs from the day on which you acquire physical possession of the last item of goods.

To exercise the right of withdrawal, you must inform us (Bio-Weingut Frühwirth, contact details see Legal notice) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form set out below, although it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Warranty

The statutory warranty rights apply. Wine is a natural product; minor, variety-typical variations in colour, taste and sediment do not constitute a defect.

10. Retention of Title

The delivered goods remain our property until paid for in full.

11. Dispute Resolution

We are not obliged and not willing to take part in a dispute resolution procedure before a consumer arbitration board. (The EU Commission's online dispute resolution platform was discontinued on 20.07.2025.)

12. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory consumer protection provisions of the state in which the consumer has their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
